Melissa Shields Henderson, a single mother of five, is facing a situation many can sympathize with. Unable to send her kids to school or daycare during the pandemic, she had to find a way to balance work and taking care of her family. As a divorced mom, tough decisions were unavoidable.
In May 2020, while residing in Blairsville, Georgia, Henderson had to travel 23 miles to Blue Ridge for her job at a spa. With no other childcare options available, she made the decision to entrust her 14-year-old daughter, Linley, with the responsibility of looking after her four younger siblings.
Henderson believed she was within the law in Georgia, where children 13 and older are legally allowed to watch over younger siblings for a reasonable amount of time.
While Henderson was at her job, Linley was doing online schooling when her 4-year-old brother, Thaddeus, wandered off briefly to a nearby neighbor’s house.
Linley soon noticed that her brother had wandered off and managed to bring him back home safely within 10 to 15 minutes. However, during that brief period, a concerned neighbor had already contacted the police.
When Henderson came back from work, she was met with police officers who informed her about Thaddeus’ brief disappearance. What she didn’t realize was that this would trigger a series of far-reaching consequences.
Two weeks later, she was arrested, taken to jail, and went through the humiliating process of being booked and held in a cell. Henderson spoke of the pain and helplessness she felt, stripped of her ability to support her family.
Although her ex-husband bailed her out, the legal struggle is ongoing, adding immense pressure to Henderson’s life. If found guilty, she could face a year in prison and a $1,000 fine.
